Terms and conditions for using website

• 1. Application and interpretation of the Terms

  • 1.1. The following terms and conditions (“Terms”) apply to your use of the website www.threecubes.gg (“Website”), including any content, functionality, products, and services offered on or through Website, whether as a guest or a registered user.
  • 1.2. The Website is managed, administered and services provided by VšĮ Edukraftas (hereinafter referred to as “Three Cubes”), legal entity code 305465636, registered office address at V. Nagevičiaus g. 3, Vilnius, Lithuania, e-mail address Tadas@tryskubai.lt.
  • 1.3. The Terms constitute a contract between you ("you" or "visitor") and Three Cubes. By using the Website, you agree to be bound by these Terms. If you do not agree to the Terms, please do not use the Website.
  • 1.4. To enter into contract created by these terms, you must be an adult of the legal age of majority in your country of residence. You are legally and financially responsible for all actions using or accessing our software, including the actions of anyone you allow to access to your account. You affirm that You have reached the legal age of majority, understand and accept these Terms. If You are under the legal age of majority, Your parent or legal guardian must consent to these Terms.
  • 1.5. For the purposes of these Terms, the Services ("Services") include all of the activities that You may perform on the Website, including, but not limited to reading, viewing, asking questions, submitting, sending and receiving information and/or data of any kind on the Website.
  • 1.6. In addition to these Terms, software or services that are included in or otherwise made available to you through the Services may be subject to separate agreement between you and Three Cubes, such as end user license agreements. If these Terms are inconsistent with any such agreements, those agreements will control.
  • 1.7. Three Cubes may amend the Terms. Amendments and/or additions to the Terms shall become effective upon their publication in any form on the Website. If you continue to use the Website after the posting of amendments and/or additions to the Terms, you shall be deemed to have accepted all amendments and/or additions to the Terms. If you do not agree to the amended and/or supplemented Terms, you must immediately stop using the Website.

• 2. Your rights and obligations

  • 2.1. You have the right to use the Website and the Services in accordance with the Terms. You must act lawfully and not violate the requirements of the law, the rights of Three Cubes, other users of the Website and/or other persons. You are solely responsible for any actions you take while using the Website and the consequences thereof.
  • 2.2. When using the Website and/or the Services, you may not:
    • 2.2.1. take any action that jeopardizes or may jeopardize the proper functioning, security or integrity of the Website and/or the Services, or restricts the ability of Three Cubes to properly provide the Services and/or the ability of others to use the Website and/or the Services;
    • 2.2.2. take any action that could harm Three Cubes, other persons, their property or legitimate interests, including but not limited to illegal transactions or fraud;
    • 2.2.3. use the Website and/or any of its content to carry out and develop activities that compete with the Website and/or Three Cubes, including advertising that mentions third parties that compete directly or indirectly with Three Cubes, or the goods and/or services of such third parties, as well as references to such third parties and/or their products;
    • 2.2.4. to use the Website to transmit, send, upload, post, etc. unsolicited information, including but not limited to information prohibited by law (defamatory, offensive, discriminatory, pornographic, etc.).
    • 2.2.5. send by email, other electronic means or otherwise transmit or send any information and/or links to information with the intent to affect, or with the understanding that it will affect, the operation of the computer networks or computer equipment owned by the owners of the computer networks, or to distribute malicious software, or to distribute any unsolicited e-mails, notices, messages, communications or other information;
    • 2.2.6. use automated means, including but not limited to additional computer hardware and/or software, to process, copy, edit, review, decompile, encrypt, reprogram, reverse engineer, relocate, reassign, or redirect the data, content, and Services on the Website, in a manner other than that which is permitted by the standard Website functionality;
    • 2.2.7. remove copyright or trademarks from any copies of the Website content, create an electronic or manually reproduced database based on the Website content, host the Website content on other websites, and modify the content of a document downloaded from the Website;
    • 2.2.8. collect, store, transfer to other media, make publicly available, publish, and distribute the data of other users of the Website or data about any actions of users of the Website.
  • 2.3. By using the Website and/or the Services, you confirm that:
    • 2.3.1. you are a natural person of legal capacity;
    • 2.3.2. you understand that if you take advantage of the paid offers on the Website, you may be obliged to pay for the services you purchase and any other obligations arising from your use of such offer;
    • 2.3.3. you understand and agree that in the event that your login credentials become known to third parties, such third parties may enter into obligations which will be binding on you and you undertake to comply with such obligations and Three Cubes shall not be under any obligation to verify your identity in any manner whatsoever, other than by verifying the validity of your login ID and password.

• 3. Rights and obligations of Three Cubes

  • 3.1. Three Cubes may at any time without notice to you:
    • 3.1.1. change the Website and/or the Services or (parts thereof), all or part of the Website content, the Website functions, any information, including Visitor Content. Three Cubes shall not be held liable for any adverse consequences caused to you by such and other similar actions;
    • 3.1.2. restrict or suspend access to and/or use of the Website and/or the Services for an indefinite period of time without giving any reason;
    • 3.1.3. unilaterally decide, in its sole discretion, on the truthfulness, completeness and accuracy of the login data provided by you. In the event that you provide any data that is untrue, incomplete, inaccurate, misleading, or that does not comply with the Terms and/or the law, Three Cubes shall have the right to immediately, and without notice to you, unregister you, delete your registration, block or edit such data, and/or take any other actions;
    • 3.1.4. to restrict or terminate access to the Website, the Visitor Content and/or the Services for an indefinite period of time during preventive and/or maintenance work. In this case, you may be informed by means of a general notice published on the Website;
    • 3.1.5. discontinue the operation of the Website and the provision of the Services.
  • 3.2. Three Cubes has the right (but not the obligation) to monitor your activities on the Website, including monitoring of Visitor Content. These actions may be taken to prevent a violation of the Terms or the law, as well as to detect and remove or block unwanted information.

• 4. Suspension, restriction, and termination of services

  • 4.1. Three Cubes shall have the right, in its sole discretion, to restrict or terminate your right or ability to use the Website and/or the Services, to delete or modify the Visitor Content and the login credentials, to prohibit you from re-registering on the Website, and to take any other action in its sole discretion, if:
    • 4.1.1. you are in breach of these Terms;
    • 4.1.2. you provide fraudulent, untrue, incomplete and/or misleading information when registering or using the Website;
    • 4.1.3. you do not comply with the moral standards of society and/or the requirements of legislation;
    • 4.1.4. in Three Cubes’s opinion, it is required to do so in connection with the maintenance and/or updating of the Website;
    • 4.1.5. it is required by the competent authorities or is necessary in cases provided for by law;
    • 4.1.6. it is necessary to protect the rights and legitimate interests of Three Cubes or third parties;
    • 4.1.7. Three Cubes suspects that you have jeopardized or may jeopardize the legitimate interests of other users of the Website;
    • 4.1.8. in other cases specified in the Terms.
  • 4.2. You have the right to withdraw from the Website at any time by deleting your login credentials in the manner specified on the Website.
  • 4.3. If you cancel your registration for any reason, you will no longer be able to use the Services for which registration is required and the information contained in your registration account will be deleted. You may also be permanently deleted from any Visitor Content.

• 5. Intellectual property

  • 5.1. All rights in and to the Website and the works and other intellectual property contained therein are protected and belong to Three Cubes, its licensors, or other providers of such material.
  • 5.2. You are permitted to use the Services for your personal, non-commercial use only. You must not copy, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of the material obtained through the Services, or delete, or alter any copyright, trademark, or other proprietary rights notices from copies of materials from the Services. However, if you are otherwise in compliance with these Terms, you are permitted to use, elsewhere and on other websites, an unaltered copy of portions of the content that is publicly available on the Website for the limited, non-commercial purpose of discussing such content.
  • 5.3. You agree that any information and/or data that you provide, post, input or otherwise transmit using the Website ("Visitor Content") shall become part of the Website and shall be retained and used by Three Cubes and/or its authorized agents in perpetuity and in an unlimited territory. Neither Three Cubes nor any other third party using such Visitor Content will be obligated to pay you any compensation for the use of the Visitor Content.
  • 5.4. From the moment that the Visitor's Content reaches Three Cubes in any way, the visitor grants Three Cubes the following exclusive rights to the Visitor's Content free of charge, in perpetuity and in an unlimited territory:
    • 5.4.1. the right to reproduce, publish, publish, make available to the public and distribute in any form or by any means whatsoever, whether by way of sale, lease, making available to use it gratuitous, or other transfer of ownership;
    • 5.4.2. the right to modify or adapt, create derivative works from the information provided by the visitor;
    • 5.4.3. to use the Visitor Content gratuitously in any manner, for any purpose or form.

• 6. Liability and limitation of liability

  • 6.1. Three Cubes makes no representations and/or warranties that the operation of the Website and/or the Services on the Website will be proper, timely, uninterrupted, error-free, of high quality, or that the Website and/or the Services will not cause any adverse consequences to you or any third party. Three Cubes is not and will not be liable for any inconsistencies, inaccuracies, or incorrectness of the content on the Website, including the information on the Services and the description of the Services, and for any adverse consequences for you or any third party arising therefrom.
  • 6.2. To the maximum extent permitted by law, Three Cubes shall not be liable for any damage and/or loss which you may suffer as a result of your use of the Website and/or Services, whether or not Three Cubes has been informed of such damage or the possibility of such damage. By using the Website and/or the Services, you agree that such limitation shall apply to all uses, services, and content of the Website. To the extent that Three Cubes’s liability for damages could not be fully limited and Three CUbes could not be exempted from liability in accordance with applicable law, Three Cubes's liability to you and/or third parties arising out of these Terms shall be limited to an amount of EUR 500.
  • 6.3. You are liable for any damage caused or likely to be caused to Three Cubes and/or third parties as a result of your use of the Website and/or Services. You undertake to ensure that Three Cubes shall not incur any legal liability, obligation to pay, indemnify or otherwise compensate for any loss, damage or other expense arising out of your use of the Website and/or Services.

• 7. Applicable law and dispute resolution

  • 7.1. The Terms shall be governed by the law of the Republic of Lithuania.
  • 7.2. Any dispute between you and Three Cubes regarding the performance of the Terms shall be settled by negotiation and in accordance with these Terms and the text thereof. If the parties fail to resolve the dispute by negotiation within 30 (thirty) days from the date on which one of the parties has served to the other party a request for settlement, such dispute shall be finally settled in accordance with the procedure established by the laws of the Republic of Lithuania in the courts of the Republic of Lithuania in the jurisdiction of the seat of Three Cubes.
  • 7.3. The subject of out-of-court settlement of consumer disputes, which is competent to resolve consumer disputes arising from these Terms, is the State Consumer Rights Protection Authority (address: Vilniaus g. 25, LT-01402 Vilnius, tel. +37052626751, e-mail tarnyba@vvtat.lt; website http://www.vvtat.lt) or http://ec.europa.eu/odr/.

• 8. Final provisions

  • 8.1. All notices and information between you and Three Cubes will be sent electronically; to Three Cubes at the addresses set out in these Terms or on the Website, and to you at the addresses set out during registration.
  • 8.2. Information sent to you will be deemed to have been received 3 (three) hours after it has been sent. The existence of a copy of the email or other communication sent to you at Three Cubes or on a server (database or other device storing relevant information) used by Three Cubes shall be adequate evidence of the sending of information to you.
  • 8.3. The parties agree that Three Cubes may assign its rights and obligations under these Terms to third parties at any time without your consent by notifying you on the Website.
  • 8.4. The Privacy Policy and the descriptions of the Services published on the Website shall be deemed to be appendices to the Terms, forming an integral part of the Terms and having the same legal effect as the Terms.
